RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

Please read this agreement carefully before signing. This is a legal document. By signing below, you (and your child, if applicable) are giving up certain legal rights, including the right to sue or recover damages in the case of injury, death, or property damage, for any reason, including but not limited to the negligence of Los Sagrados Sanctuary, its owner, staff, volunteers, and agents (collectively, the "Releasees").

This agreement applies to all participants at Los Sagrados Sanctuary, including paid guests taking part in trail rides, lessons, or other mounted experiences ("Participants"), and to unpaid volunteers assisting with animal care, ranch work, or any other sanctuary activity ("Volunteers"). Participants and Volunteers are together referred to below as "the Undersigned."

1. Our Rescue Mission

Los Sagrados Sanctuary rescues and rehabilitates horses and donkeys who have often come from situations of neglect, abuse, or hardship. Many of the animals in our care are still healing, physically and behaviorally, and their full histories are not always known. This means their reactions can be less predictable than those of animals with a long, documented training history. The Undersigned acknowledges this rescue context and understands it as part of the inherent risk described below.

2. Acknowledgment of Risk

The Undersigned acknowledges that a horse or donkey may, without warning or any apparent cause, buck, stumble, fall, rear, bite, kick, run, spook, jump, make unpredictable movements, step on a person's feet, or push or shove a person. Saddles, halters, or other equipment may loosen or break. Any of these events may cause a rider or handler to fall, be thrown, or be otherwise injured, resulting in serious injury or death.

THE UNDERSIGNED ACKNOWLEDGES THAT HANDLING, RIDING, OR WORKING AROUND HORSES AND DONKEYS IS AN INHERENTLY DANGEROUS ACTIVITY THAT INVOLVES RISKS OF SERIOUS INJURY OR DEATH, due to the unpredictable and sometimes irrational behavior of these animals, regardless of their training, temperament, or past performance. This risk applies whether the Undersigned is riding, leading, grooming, feeding, mucking, bathing, or otherwise interacting with the animals in any capacity.

3. Assumption of Risk

The Undersigned voluntarily assumes all risk and danger of injury, illness, or death inherent in riding, handling, or being near horses and donkeys, and in using any equipment or gear provided by Los Sagrados Sanctuary, whether as a paying guest or as a volunteer.

4. Release and Promise Not to Sue

In exchange for being allowed to ride, handle, or work with the horses and donkeys at Los Sagrados Sanctuary, the Undersigned, on behalf of themselves and their child (if applicable), personal representatives, heirs, next of kin, spouses, and assigns, RELEASES, DISCHARGES, AND PROMISES NOT TO SUE Los Sagrados Sanctuary, its founders, board, staff, volunteers, and agents (the "Releasees") for any loss, liability, damage, or cost of any kind arising out of or related to any loss, damage, or injury, including death, to the Undersigned's person or property.

This release includes any claim that the Releasees were negligent in connection with the Undersigned's riding or volunteer experience, including but not limited to the selection, training, or handling of the animals; the maintenance, fit, or adjustment of tack and equipment; instruction; or the supervision of riders, handlers, or volunteers.

5. Indemnification

The Undersigned agrees to INDEMNIFY AND HOLD HARMLESS Los Sagrados Sanctuary, its staff, volunteers, and agents from and against any loss, liability, damage, or cost they may incur arising out of or in any way connected with the Undersigned's use of any animal or equipment, or any act or omission by the Undersigned while riding, handling, or volunteering at the sanctuary.

6. Governing Law

Los Sagrados Sanctuary operates as a Mexican Asociacion Civil (AC) based in El Pescadero, Baja California Sur, Mexico. This agreement is governed by and interpreted under the laws of Mexico and the state of Baja California Sur, and is intended to be as broad and inclusive as permitted under applicable Mexican law. RIDE, HANDLE, AND VOLUNTEER AT YOUR OWN RISK.

If any portion of this agreement is found to be invalid, illegal, or unenforceable, the remaining portions shall remain in full force and effect.

7. Legal Costs

The Undersigned agrees that if a claim or legal action is brought against Los Sagrados Sanctuary or its founders, staff, volunteers, or agents for injury or damage in connection with this agreement, and that claim is barred by this agreement, the Undersigned will be responsible for reasonable costs and fees incurred by Los Sagrados Sanctuary in defending against it, to the extent permitted by applicable law.

8. Medical Acknowledgment

The Undersigned confirms that they are not pregnant and have no history of seizures, heart conditions, or any other medical condition that could be affected by horseback riding, animal handling, or ranch work. Anyone with a relevant medical condition should consult a physician before participating and should inform sanctuary staff in advance.

9. Helmets and Safety Equipment

It is recommended that all riders, including minors, wear a protective helmet. The Undersigned acknowledges that a protective helmet is available and has been offered for their own or their child's safety.

10. Volunteers

Volunteers additionally acknowledge that ranch and rescue work may involve physical labor, exposure to animals in various states of health or temperament, and the use of tools or equipment for feeding, mucking, grooming, and general ranch maintenance. Volunteers agree to follow all safety instructions given by Los Sagrados Sanctuary staff and to report any injury, illness, or unsafe condition promptly.

11. Minors

If the person entering into this agreement is under eighteen years of age, a parent or legal guardian must read this agreement in full and sign on the minor's behalf.

12. Photo and Video Acknowledgment

The Undersigned understands and agrees that photos and videos taken during their visit or volunteer time may be used by Los Sagrados Sanctuary for marketing, fundraising, and other public purposes, including on social media and the sanctuary website.
